The protection of plant varieties serves for the protection of the designation and use of seeds. In this connection a new variety of plant can be created by cultivation or by deliberate manipulation of its genes (genetic engineering). No repeatability is required for the granting of protection of plant varieties. Durability suffices.

The application for the protection of a variety is made to the BSA, the Federal Office for the National Listing and Protection of Plant Varieties. Here a check of the protective right is made ex officio by cultivating the variety.
